In reply I beg to make the following Statement subject to our Title to the Lots in question.

On the question, for the information of H.E., being that H.E. is not sufficiently acquainted with the whole circumstance of the case.

These lots were offered for sale to Mr. Kinsley and myself by Mr. Shuck, the representative of Captains Theck, and we agreed to purchase them on condition that he would cause them to be transferred to our names at the Land Office. Accordingly, reference was made to Mr. Regusto, the officer in charge, and through him to A.A. Johnston Esq. in charge of the fort, who, under date the 14th October ultimo, addressed a letter to Mr. Shuck on the subject, of which I have a copy (marked A.), from which you will perceive that Mr. Shuck considered that Captain Theck "had made every effort in his power to erect Buildings on the Lots as evidenced by the Walls partially 'raised'" and that therefore he had directed the Land Inspector to register the sale of them on application being made to that effect.

In virtue of this authority, the lots were registered in the names of Mr. Kinsley and myself, and the sale was closed by payment of the purchase money, and I beg to transmit you a Copy of the Certificate of Registry granted by the Land Officer to myself for the six lots belonging to us (marked B.).

I further beg to transmit you a copy of a letter (marked C.) of date the 26th Nov?, addressed to me by the Land Inspector, informing me that he had been desired by A.R. Johnston Esq. to request that I would clear away part of the ruined Walls.
